Esta vinculaci\u00f3n de los mandatos laborales a los incentivos fiscales para los proyectos de construcci\u00f3n del sector privado a nivel federal no tiene precedentes.<\/p>\n<p>La IRA exige que al menos 15% del total de horas de trabajo de un proyecto sean realizadas por un \"Aprendiz Cualificado\" (es decir, un Aprendiz Registrado) para 2024. Este requisito se aplicar\u00e1 gradualmente a lo largo de tres a\u00f1os:<\/p>\n<ul>\n<li>10% en 2022<\/li>\n<li>5% en 2023<\/li>\n<li>15% en 2024 y m\u00e1s all\u00e1<\/li>\n<\/ul>\n<p>Los proyectos deben seguir los ratios determinados por el Departamento de Trabajo o los Consejos Estatales de Aprendizaje. Para los proyectos elegibles que requieran cuatro o m\u00e1s trabajadores, cada contratista y subcontratista debe emplear a uno o m\u00e1s aprendices cualificados. A continuaci\u00f3n se indican algunas excepciones a este requisito:<\/p>\n<ul>\n<li>El contratista pagar\u00e1 una penalizaci\u00f3n de $50 multiplicada por el total de horas de trabajo por las que no se haya cumplido el requisito.<\/li>\n<li>Esfuerzo de buena fe: el contratista solicita aprendices cualificados a un Programa de Aprendizaje Registrado y la solicitud es denegada o el Programa de Aprendizaje Registrado no responde a la solicitud en un plazo de 5 d\u00edas laborables. Los contratistas deben seguir las normas y requisitos establecidos del Programa de Aprendizaje Registrado. La sanci\u00f3n econ\u00f3mica puede aumentar a $500 por hora si la infracci\u00f3n se considera deliberada.<\/li>\n<\/ul>\n<p>Requisitos salariales para la bonificaci\u00f3n de proyectos subvencionables:<\/p>\n<ul>\n<li>Para recibir el cr\u00e9dito de bonificaci\u00f3n, los trabajadores deben percibir salarios no inferiores a las tarifas vigentes (tarifas salariales Davis-Bacon) durante la duraci\u00f3n del cr\u00e9dito subvencionable. Para satisfacer el incumplimiento y mantener la elegibilidad para el cr\u00e9dito completo, los empleadores pueden proporcionar salarios atrasados, m\u00e1s intereses y una multa de $5.000 por trabajador o $10.000 por trabajador para las violaciones debidas a la desatenci\u00f3n intencional. This tying of labor mandates to tax incentives for private sector construction projects at the federal level is unprecedented.<\/p> <p>The IRA requires that at least 15% of total labor hours on a project must be performed by a \u201cQualified Apprentice\u201d (i.e. a Registered Apprentice) by 2024. This is phased in over three years:<\/p> <ul> <li>10% in 2022<\/li> <li>5% in 2023<\/li> <li>15% in 2024 and beyond<\/li> <\/ul> <p>Projects must follow ratios determined by the Department of Labor or State Apprenticeship Councils. For eligible projects that require four or more laborers, each contractor and subcontractor must employ one or more qualified apprentices. Below are some exceptions to this requirement:<\/p> <ul> <li>Contractor pays a penalty of $50 multiplied by the total labor hours for which the requirement was not satisfied.<\/li> <li>Good faith effort \u2013 contractor requests qualified apprentices from a Registered Apprenticeship Program and the request is denied or the Registered Apprenticeship Program fails to respond to the request within 5 business days. Contactors must follow established standards and requirements of the Registered Apprenticeship Program. Financial penalty can increase to $500 per hour if the violation was deemed deliberate.<\/li> <\/ul> <p>Prevailing wage requirements for bonus credit on eligible projects:<\/p> <ul> <li>To receive the bonus credit, workers must be paid wages not less than prevailing rates (Davis-Bacon wage rates) for the duration of the eligible credit. To satisfy noncompliance and maintain eligibility for the full credit, employers can provide back pay, plus interest and a penalty of $5,000 per worker or $10,000 per worker for violations due to intentional disregard.
